Growing Ambitions Community Interest Company (CIC): Terms and Conditions for volunteer Speakers from the workplace hereafter known as the ‘Service User’ relative to the services provided by Growing Ambitions CIC, hereafter known as the ‘Supplier’.

This Agreement represents the Terms and Conditions that apply between the Service User and the Supplier in relation to the provision of careers talks by voluntary Speakers from the workplace. By registering for the Growing Ambitions service, Service Users agree to be bound by them.

1 Online Registration Form

The Service User undertakes to complete, accurately and honestly, the online Speaker Registration form. The Supplier accepts no responsibility for incorrect information supplied.

2 Repeat visits

The Service User undertakes to refrain from offering their Speaking services direct to the School for future occasions, but rather to volunteer through the Growing Ambitions site again. The small Speaker Fees charged to Schools, helps fund promotion of the service UK-wide and so to benefit as many young people as possible.

3 Indemnification

The Service User agrees to indemnify the Supplier and its employees and directors against any action arising from the introduction to educational establishments made through this service.

4 Criminal Records Bureau (CRB) checking In agreeing to these Terms and Conditions the Service User declares that he/she has no criminal record. The Service User also acknowledges that educational establishments may contact them to initiate the CRB checking process. The Service User will not be CRB checked by the Supplier. For Service Users speaking to young people in any education establishment, in the event that a teacher or member of staff not being present in the room when the Service User arrives to speak, the Service User vouchsafes to insist that a member of staff is brought in for the full duration of the talk and question session. This is a strict requirement on the part of the educational establishment and must be adhered to. The Supplier, not its supporters, endorsers or sponsors, accept no liability in cases where this requirement is not met.

5 ‘No Show’

The Service User vouchsafes to do everything possible to honour speaking engagements, and to inform the educational establishment involved of any unavoidable delays or their inability to attend, as far in advance as possible., and arrange an alternative date. The Service User vouchsafes to inform the Supplier, if they are unable to attend a Speaking engagement.

6 Quality

The Service User agrees to do their best to deliver a quality, informative and useful career talk, and to refrain from bringing the reputation of the Supplier into disrepute.

7 Health and Safety
The Service User agrees to act responsibly when on a visit, not placing themselves at risk in any way.

8 Appointment time flexibility

The Service User agrees to be as flexible as their work schedules allow in modifying Speaking times when requested to do so on days when the educational establishment has booked them to speak.

9 Selling to educational establishments

The Service User vouchsafes not to attempt to actively sell or market their organisation’s products or services to the educational establishment before, during or after any visit, unless explicitly invited to do so by the staff of the aforementioned establishment.

10 Force majeure

The Supplier shall not be liable for any delay or failure in the performance of its obligations under this Agreement that is due to or results from any acts, events, omissions, happenings or non-happenings beyond its control including: acts of God; strikes; work stoppages; public transport strikes; governmental regulations, acts or directives; war; riot; fire; flood; civil commotion or acts of terrorism.

11 UK Law

These terms and conditions are governed and construed in accordance with the laws of the United Kingdom.

12 Statutory Rights

These terms and conditions do not affect your statutory rights as a consumer.

DEFINITIONS

Speaker Slot

The date and time when a Speaker (Service User) is available to speak. Speakers are encouraged to volunteer for a minimum of 4 slots in any 12 calendar month period.

SUPPLIER’S RESPONSIBILITIES

PR opportunities for Speakers’ organisations

The Supplier will make every reasonable effort to include a Speaker’s organisation in a PR programme when requested so to do, as promotional funding allows.

‘Quality’ talks

The Supplier makes every reasonable effort to ensure that the talk is of good quality and genuinely useful, through guidance provided by the Supplier.

‘No shows’

The Supplier undertakes, through 3 autogenerated emails, to remind the Service User of forthcoming and imminent Speaking obligations. A map will also be provided of the location of the educational establishment concerned.

Disclosure and use of data supplied by the Service User

Growing Ambitions CIC is Registered with the UK’s Data Protection authority (Reg. No. Z9640369).

Indemnification of the Supplier

The Service User agrees to indemnify the Supplier and employees and directors against any action arising from action on the part of the same said Service User.

Breach and revocation

The Supplier reserves the right to suspend, cancel or refuse access to the service to any Service User in the event that (a) the Service User breaches this Agreement (b) the Service User provides false or inaccurate information (c) the Service User acts improperly whilst on the premises of any educational establishment they visit through this service (d) the Service User breaches the Supplier’s Acceptable Usage Policy.

Dispute

Complaints about the service supplied by this site should be made in writing to: The Managing Director, Growing Ambitions CIC, Hads House, 9 Preston Road, Portsmouth PO2 7JT. Receipt will be acknowledged by email within 5 working days and details of action the company proposes to take in response to your complaint outlined therein. Complaints will be treated in the strictest confidence.

Acceptable Use

The following is deemed unacceptable Service User behaviour: hacking into the system; spamming; posting adult content; using defamatory, blasphemous language on line or whilst during a Speaker visit; destructive or illegal activities; engaging in any activities which the directors of Growing Ambitions CIC deem harmful to the educational establishments it serves, other Speaker volunteers, and its reputation and goodwill.
