Growing Ambitions Limited: Terms and Conditions for a School, FE College or University hereafter known as the ‘Customer’. This Agreement represents the Terms and Conditions that apply between the Service User and the Supplier in relation to the provision of careers talks delivered to educational establishments by voluntary Speakers from the workplace. By registering for the Growing Ambitions service, the Customer agrees to be bound by them. 1 Online Registration Form The Customer undertakes to complete as accurately as possible the online School Registration form. Growing Ambitions accepts no responsibility for incorrect information supplied.
2 Repeat Speaker visits The Customer undertakes to request that Speakers who are keen to speak at the School on any future occasion, to use the Growing Ambitions service again rather than coming ‘direct’ for a repeat visit.
3 Indemnification The Customer agrees to indemnify Growing Ambitions Limited and employees and directors against any action arising from Speakers’ services obtained through this service.
4 Criminal Records Bureau (CRB) checking The Customer acknowledges that Speakers are not CRB-checked by Growing Ambitions CIC. Customers undertake to ensure a teacher/member of School staff is always present in the room when a Speaker is with young people. This is a strict condition of using this service and must be adhered to without exception. Growing Ambitions CIC accepts no liability in cases where this requirement is not met.
5 Insurance The Customer agrees to cover visiting Speakers under their Public Liability insurance. 6 Health and Safety The Customer agrees to make every endeavour to ensure the Health and Safety of Speakers visiting the premises and to ensure any relevant Health and Safety information is passed to Speakers, for example, the location of Fire Exits. The Customer agrees to notify Growing Ambitions within 24 hours should a Speaker incur an injury during the visit. 7 Refund policy The Customer accepts that no refunds of Registration Fee or Speaker Fees are made during any 12 months use of the service. However, should Growing Ambitions be notified of a particularly poor-quality careers talk, or ‘no show’, the Speaker’s Fee of £20 will be donated to the education division of the charity World Vision, for projects in the developing world.
8 Force majeure The Supplier shall not be liable for any delay or failure in the performance of its obligations under this Agreement that is due to or results from any acts, events, omissions, happenings or non-happenings beyond its control including: acts of God; strikes; work stoppages; public transport strikes; governmental regulations, acts or directives; war; riot; fire; flood; civil commotion or acts of terrorism.
9 UK Law These terms and conditions are governed and construed in accordance with the laws of the United Kingdom.
10 Statutory Rights These terms and conditions do not affect your statutory rights as a consumer.
DEFINITIONS Customer Registration Fee The sum of £100 payable to the Supplier via PayPal that entitles the Customer to 12 months’ uninterrrupted access to book any of the Speakers who volunteer through the site. Renewal One month prior to the expiry of any 12-month Registration period the Supplier will give the Customer an option to renew registration for a further 12 months, and a further £100 fee. Speaker Slot The date and time when a Speaker is available to speak, and for which the Speaker fee of £20 is payable, to book. Acceptable Use The following is deemed unacceptable customer behaviour: hacking into the system; spamming; posting adult content; using defamatory, blasphemous language; destructive or illegal activities; engaging in any activities which the directors of Growing Ambitions CIC deem harmful to its customers, volunteers, its reputation and goodwill. SUPPLIER’S RESPONSIBILITIES Supply of Speakers The Supplier will make every reasonable effort – through online publicity, sponsored advertising and PR programmes and emarketing – to encourage individuals across as wide a range of occupations as possible, throughout the UK, to volunteer as Speakers through the site. The Supplier will also work with sponsors, professional organisations and trade associations to maximise awareness of, and take up, of volunteering through this site. Whilst, the Supplier cannot accept any responsibility for the lack of Speakers for particular job types in any particular town, it welcomes information from service users as to skill gaps, which will then be addressed through promotional channels aforesaid mentioned as far as funding allows. ‘Quality’ talks The Supplier makes every reasonable effort to ensure that the talk is of good quality and genuinely useful, through guidance provided to volunteer Speakers. ‘No shows’ The Supplier makes every reasonable efforts through 3 autogenerated emails to remind Speakers of a forthcoming and imminent Speaking obligation. Maps are also provided of the location of the educational establishment that they are to visit. When informed of a ‘no show’ the Supplier vouchsafes to donate the Speaker fee to the charity, World Vision. Disclosure and use of data supplied by the customer
Growing Ambitions CIC is Registered with the UK’s Data Protection authority (Reg. No. Z9640369). In compliance with current Data Protection legislation the Supplier will not share information with any third party on any educational establishment or the payee of the Registration and Speaker fees, where different, that is registered on this site. Indemnification of the Supplier The Customer (registered user) agrees to indemnify the Supplier and employees and directors against any action arising from action on the part of the Customer. Breach and revocation The Supplier reserves the right to suspend, cancel or refuse delivery of the service to any Customer in the event that (a) the Customer breaches this Agreement (b) the Customer provides false or inaccurate information (c) the Customer breaches the Supplier’s Acceptable Usage Policy. Dispute Complaints about the services supplied by the Supplier should be made in writing to: The Managing Director, Growing Ambitions CIC, Hads House, 9 Preston Road, Portsmouth PO2 7JT. Receipt will be acknowledged by email within 5 working days and details of action the company proposes to take in response to your complaint outlined therein. Complaints are treated in the strictest confidence. |
